The Chief Magistrate Court 3 sitting in Warri South Local Government Area of Delta State on Monday June 25 remanded into the Federal Prisons in Okere,the seventy three year old native doctor, Joseph Umuluku for allegedly raping a thirteen year old (Names withheld).
The remand follows an expart motion filed moved by the International Federation of Women Lawyers, FIDA.
The girl in.question, is said to be seven weeks pregnant as a result of the rape by the native doctor.
In the motion with Charge Number: MW/138c/2018/, Mrs. Vanessa.O.Kubenyinje-Ngwu, an Assistant Chief State Principal Counsel prayed the Court for,”An order of this Honourable Court reminding the defendant at Federal Prison, Okere,Delta State pending the legal advice from the office of the Attorney-General and Commissioner for Justice of the Delta State.
Kubenyinje-Ngwu who was flanked by Mrs. Ogechi.J. Megbele, an Assistant Chief State Principal Counsel also prayed the Court for “An order directing the registrar of this Court to forward the duplicate case file already served on the Court to the office of the Attorney-General and Commissioner of Justice of the Delta State legal advice.
“And for such further or other as this Honorable Court may deem fit to make in the circumstance”.
Counsel to the defendant, E.P. Okoro Esq and his team were silent on the matter during the court proceedings.
The Court presided over by E.O. Bakpa Arukpere (Mrs.) quickly remanded the defendant and adjourned the case to July 11.
As at the time of filing this report, the defendant was being taken to prison.
